Welcome to Squishy Studio. These Terms & Conditions (“Terms”) govern your use of squishystudio.com (the “Site”), any purchase you make from us online or in our gallery, and your participation in our SMS text messaging program. By using the Site, making a purchase, or opting in to receive text messages from us, you agree to these Terms. If you do not agree, please do not use the Site or our services.

“Squishy Studio,” “we,” “us,” and “our” refer to Squishy Studio LLC, a Las Vegas Arts District gallery and gift shop located at 1219 S. Main Street, Las Vegas, Nevada.

1. Use of the Site

You may use the Site for lawful purposes only. You agree not to interfere with the operation of the Site, attempt to gain unauthorized access to any part of it, or use automated tools to copy or scrape its content. We may suspend or terminate access to anyone who violates these Terms.

2. Artwork, Products, and Intellectual Property

All artwork, images, photographs, text, logos, and other content on the Site are owned by Squishy Studio or by the artists we represent and are protected by copyright and other intellectual property laws. Purchasing an original artwork, print, or gift item transfers ownership of that physical item only; it does not transfer copyright or reproduction rights, which remain with the artist. You may not reproduce, distribute, or create derivative works from any content on the Site without written permission.

3. Orders, Pricing, and Payment

Prices are listed in U.S. dollars and may change without notice. We make every effort to display products accurately, but colors and details of original and handmade items may vary slightly from what appears on your screen. We reserve the right to refuse or cancel any order, including for pricing errors, suspected fraud, or unavailability. If we cancel an order after payment, you will receive a full refund.

4. Shipping, Returns, and Exchanges

Shipping times are estimates and are not guaranteed. Risk of loss passes to you when the item is delivered to the carrier. Because many of our items are one-of-a-kind or handmade, returns and exchanges are handled on a case-by-case basis. Please contact us within 7 days of receiving your order if an item arrives damaged or is not what you ordered, and we will work with you to make it right.

5. Events and Appointments

Event details, including First Friday and group show dates, may change. Appointment requests submitted through the Site are not confirmed until you receive a confirmation from us. We may photograph events held at the gallery for promotional use.

6. SMS Text Messaging Program

Program description

Squishy Studio offers an SMS program that sends text messages about gallery news, new artwork and artists, First Friday and other events, promotions, order and appointment updates, and replies to your inquiries.

How to opt in

You can opt in by entering your mobile number and checking the SMS consent box on our website, by texting a keyword we provide to our number, or by giving us your number in the gallery and asking to receive texts. By opting in, you consent to receive recurring automated text messages from Squishy Studio at the mobile number you provide. Consent is not a condition of any purchase.

Message frequency

Message frequency varies, but you will receive 5 or fewer messages per month.

Message and data rates may apply. Check with your wireless carrier for details about your plan.

How to opt out

You can cancel at any time by replying STOP to any message we send you. After you send STOP, we will send one final message confirming that you have been unsubscribed, and you will receive no further messages. To rejoin, sign up again as you did the first time and we will start sending messages to you again.

Privacy of your mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Your text messaging originator opt-in data and consent will not be shared with any third parties. We may share your mobile number only with the service providers who help us send messages on our behalf, and only for that purpose. See our Privacy Policy for more details on how we handle your information.

Carrier disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Messages are supported on major U.S. carriers, but delivery is subject to effective transmission from your network operator and is not guaranteed.

Your responsibilities

You confirm that you are the account holder or have the account holder’s permission to enroll the mobile number you provide, and that you are at least 18 years old. If you change or deactivate your mobile number, please notify us by texting STOP from the old number or emailing support@squishystudio.com so we can update our records.

7. Privacy

Your use of the Site and our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. The SMS privacy commitments in Section 6 above apply in addition to the Privacy Policy.

8. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Squishy Studio LLC and its owners, employees, and artists will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site, our products, or our SMS program. Our total liability for any claim relating to a purchase will not exceed the amount you paid for that purchase.

10. Indemnification

You agree to indemnify and hold harmless Squishy Studio LLC and its owners, employees, and artists from any claims, losses, or expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Site.

11. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law principles. Any dispute arising from these Terms will be brought in the state or federal courts located in Clark County, Nevada.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the “Last updated” date above will reflect the most recent revision. Your continued use of the Site or the SMS program after changes are posted constitutes acceptance of the updated Terms.
